Uniformed Services Employment and Reemployment Rights Act (USERRA) is the federal law that bars discrimination and retaliation in employment and benefits based on a person's military status, and protects and individual's right to reemployment, health insurance, pensions, and fringe benefits based on a person's military status, and protects and individual's right to reemployment, health insurance, pensions, and fringe benefits after their term of military service ends. In general, the returning employee has the right to be promptly reinstated into a position he or she would have been in ( or in some cases, a comparable position), given the passage of time, had the military service not occurred.

A successful USERRA Plaintiff is entitled to reinstatement and/or compensation for lost wages and benefits, as well as attorney's fees and costs. An employer also may be ordered to pay damages -or double backpay- to the plaintiff where it is established that the employer's USERRA violation was willfull, that is, the employer showed reckless disregard of the plaintiff's federally protected rights.
